Creator Program Terms

About these terms

These terms are between you and Martinez Solutions LLC, Glendale, Arizona, United States (“we”), and apply when you apply to or take part in the Mekat Creator Program (the “Program”). Our Service Terms and Privacy Policy also apply. Applications are not open yet; these terms apply once they open.

Applying and approval

You apply on mekat.ai. You must be at least 18, able to enter a binding contract, and able to receive payouts through Stripe in your country. We review every application by hand and may approve or decline it for any lawful reason. Applying does not guarantee acceptance.

If we approve you, we tell you your commission settings (see below) in your approval and in your creator dashboard. You join the Program when you accept these terms in your dashboard.

Your links and codes

When we approve you, we assign your creator code and link (such as mekat.ai/r/your-code); you can suggest a code when you apply. Once active, you can also create extra campaign links in your dashboard. A code must not copy or suggest another person’s or company’s name or trademark, and must not be offensive. We may reject, change or turn off a code or link that breaks these rules.

• A customer who opens your link gets a cookie that remembers your code for 30 days.
• A code the customer types takes priority over a link until their first paid purchase.
• Once the customer’s first paid purchase is made, the creator linked to their account is locked.
• Customers can choose not to use a creator, and we do not credit you then.

A referral counts only when we can verify it: the customer must use your link or code on mekat.ai and buy a Mekat Premium membership through mekat.ai checkout while linked to you. Purchases made only in the App Store, or that we cannot connect to your code, do not earn a commission.

Commissions

Your commission settings are the commission rate, how long you earn on each referred customer and how long each commission is held. The standard settings are:

• 15% of each payment the referred customer makes,
• for payments in the customer’s first 12 months after their first paid purchase,
• with each commission held for 30 days before it can be paid out.

We may agree different settings with you. Your settings are shown in your approval and your dashboard, and the settings in force when a referred customer is first linked to you apply to that customer.

Commission is calculated on the membership price the customer paid, as reported by our checkout provider, before payment-processing fees. Free trial time earns nothing. If a payment is refunded, charged back or reversed, its commission is reversed too, including after it was paid out; a reversal may reduce your balance below zero until later commissions cover it.

Your dashboard shows each commission as pending, available or reversed. A dashboard entry is a record, not a payment; payment happens only through a payout.

Payouts

You set up payouts through Stripe Connect. You give your identity, tax and bank details directly to Stripe and accept Stripe’s Connected Account Agreement. We never see your full bank or tax details.

Available commissions are paid to your Stripe account in the currency they were earned in. Payouts are prepared and approved by our team, so they are not instant. Stripe may apply its own verification, timing and fees for your country. We may hold a payout while we review suspected fraud, a chargeback or an error, and we will tell you why where we lawfully can.

You are responsible for the taxes on your commissions. Stripe may collect tax forms and issue tax documents where the law requires.

How to promote Mekat

• Be honest. Describe Mekat accurately, and don’t promise results, prices, discounts or trials that Mekat doesn’t offer.
• Disclose the relationship. Clearly tell your audience you may earn a commission, as the FTC Endorsement Guides and similar laws require.
• Don’t buy ads that bid on “Mekat” or our other brand names, or use our brand in a way that looks like it comes from us.
• Don’t spam, use fake reviews, use misleading redirects or cookie stuffing, or pay people to sign up.
• Don’t use your own link or code, or those of people in your household, for your own purchases.
• Follow the rules of the platforms you post on.

You may use the Mekat name, Scout and brand materials we give you only to promote Mekat under these terms, and you must stop when you leave the Program.

Changes, suspension and ending

We may change these terms or the standard commission settings. We will give you at least 30 days’ notice by email or in your dashboard before a change that reduces your commissions takes effect; commissions already earned are not reduced by a change.

We may suspend you or end your participation if you break these terms, if we suspect fraud, or if we close the Program, with notice where practical. You can leave at any time by emailing us. When participation ends, your links and codes stop working. Commissions earned in good standing before the end are still paid once they become available; commissions from fraud or a breach are forfeited.

Relationship and liability

You are an independent creator, not our employee, agent or partner, and you cannot make promises on our behalf. The Program is provided as is. To the extent the law allows, neither side is liable to the other for indirect or lost-profit damages under the Program, and our total liability to you under the Program is limited to the commissions you earned in the 12 months before the claim. Nothing in these terms limits liability that the law does not allow to be limited.

These terms are governed by the laws of the State of Arizona, United States, without regard to its conflict-of-law rules.
