This agreement
This End-User License Agreement (“Agreement”) is between you and Martinez Solutions LLC (“we”, “us”), the developer of the Mekat app for iPhone (“Mekat” or the “App”). It applies when you download, install or use Mekat. If you do not agree, do not use the App.
This Agreement is between you and Martinez Solutions LLC only, not with Apple Inc. (“Apple”). We, not Apple, are solely responsible for Mekat and its content.
The Service Terms and Privacy Policy also apply to your use of Mekat and are part of this Agreement. If this Agreement conflicts with them about the software license, this Agreement controls.
Your license
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to download, install and use Mekat for your own learning on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. Mekat may also be accessed by other accounts associated with you through Family Sharing or volume purchasing where Apple permits it.
Mekat is licensed, not sold. Mekat’s software, lessons, Scout the meerkat and other brand materials remain owned by Martinez Solutions LLC or its licensors. You keep the rights to what you write.
You must be at least 13 years old, and older if the law where you live sets a higher minimum age. If you are under the age of legal adulthood where you live, a parent or guardian must agree to this Agreement for you.
What you may not do
You may not rent, lease, lend, sell, redistribute or sublicense Mekat; copy or publish substantial parts of its lessons; get around its security, account or subscription controls; or decompile, reverse engineer or disassemble it, except where applicable law expressly allows this despite this restriction. Open-source parts of Mekat are governed by their own licenses, listed on the Credits & Licenses page.
Free trial and subscriptions
The first introduction lesson is free. After creating an account you can start a 14-day free trial of Mekat Premium through Apple’s subscription flow. Unless you cancel at least 24 hours before the trial ends, the subscription you chose starts automatically when the trial ends and your Apple Account is charged. Cancel in iPhone Settings → your name → Subscriptions.
Mekat Premium is an auto-renewable subscription sold through the App Store: Weekly ($2.49 USD), Monthly ($7.99 USD) or Yearly ($59.99 USD). The App Store shows your local price before you buy. There is no lifetime plan.
Payment is charged to your Apple Account when you confirm the purchase. Your subscription renews automatically for the same period and price unless you cancel at least 24 hours before the end of the current period, and your Apple Account is charged for renewal within the 24 hours before the period ends. Manage or cancel your subscription in your Apple Account settings (iPhone Settings → your name → Subscriptions). Deleting the App or your Mekat account does not cancel a subscription. Refunds are handled by Apple under its policies.
Maintenance and support
We are solely responsible for providing any maintenance and support for Mekat, as described in this Agreement or required by applicable law. Apple has no obligation to provide any maintenance or support services for Mekat. Contact us using the details at the end of this Agreement.
Warranty
We are solely responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed. Mekat is educational software. Lessons, examples, optional AI feedback and Ask Scout replies can contain mistakes, and we do not guarantee any learning, job, income or other outcome. To the extent permitted by law, Mekat is provided “as is”, without other warranties.
If Mekat fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the App to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to Mekat. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our sole responsibility.
Product claims
We, not Apple, are responsible for addressing any claims by you or a third party relating to Mekat or your possession or use of it, including: (i) product liability claims; (ii) any claim that Mekat fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation.
Intellectual property claims
If a third party claims that Mekat or your possession and use of it infringes that third party’s intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of that claim.
Legal compliance
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. You agree to comply with applicable export laws when using Mekat.
Third-party terms
You must comply with applicable third-party terms of agreement when using Mekat, such as your wireless data service agreement. Outside AI tools and websites mentioned or linked in Mekat have their own terms, prices and age limits.
Apple as third-party beneficiary
Apple and Apple’s subsidiaries are third-party beneficiaries of this Agreement. Upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.
Updates and ending this Agreement
Updates we provide are covered by this Agreement unless they come with different terms. This Agreement lasts until you or we end it. You can end it by deleting Mekat from your devices. We may end it if you materially breach it, after reasonable notice where practical. When it ends, you must stop using Mekat. Ending this Agreement does not cancel an Apple subscription.
Your rights
Nothing in this Agreement limits any warranty, remedy or liability that cannot lawfully be limited, requires arbitration, or waives consumer rights that apply to you. If any part of this Agreement cannot be enforced, the rest remains in effect.
This Agreement is governed by the laws of the State of Arizona, United States, without regard to its conflict-of-law rules, except where the law of the place you live requires otherwise.
